Product Description
The harassment and discrimination desk reference for every HR professional and manager.

Employees filed more than 95,000 discrimination, harassment and retaliation claims against their employers in 2008, with the biggest jump occurring in age discrimination and retaliation claims. In these tough economic times, it's evident that more employees are considering taking their grievances to court.

Enter The Essential Guide to Workplace Harassment & Discrimination, the essential reference for human resources professionals, managers and supervisors who are responsible for addressing and preventing harassment and discrimination problems in the workplace. Taking into consideration the practical realities of applying the law in everyday situations, this guide answers common questions that you're likely to encounter regularly.

Though you'll read thorough explanations, in plain English, of the important legal principles that professionals must understand in order to deal with discrimination in the workplace, you'll also get samples, quizzes and audio scenarios that will help you to apply these principles in real-world situations. Find guidance on:

  • what harassment is and how to stop it
  • when and how discrimination occurs
  • how to draft and communicate effective policies
  • how to conduct training
  • how to handle employee complaints and investigate claims thoroughly

5 out of 5 stars Useful Guide   November 15, 2009

These days workplace harassment and discrimination is a big issue and there is plenty of litigation regarding instances of these things. I think we all know that unless you have been hiding somewhere. The thing is, a wise course to follow for any manager or HR person would be to take steps to ensure that procedures and regulations are implemented within your organization to prevent/discourage such harassment and discrimination and if it should occur, you also have procedures in place to effectively deal with it.

I felt the Nolo guide is very helpful in this respect. It is laid out in a logical, organized manner and is written in an easy to understand manner. Plenty of examples are provided. It makes for good, informative reading on its own but also serves as a reference for various issues or situations that may arise in the workplace and how they would best be handled.

A reviewer commented that the price of this book is rather steep, and felt that perhaps the CD contributed to that price. This is not a real thick book so on first glance I can see why one would feel that way. However, there are plenty of books out there with plenty of filler to make it seem like they are worth the price they charge. What you get with this guide is content that is straight to the point and is also easy to review for what you are looking for. Also, consider the price of the book versus the hourly rate of having to consult an attorney - the book costs about 1/3 to 1/4 of just one hour of time, so isn't it better to be proactive rather than reactive?

A good insurance company will provide experts to come to your organization to give talks about dealing with harassment and discrimination since it costs them a lot less to try and prevent it in the first place rather than dealing with it after a claim or suit is filed. That's a good idea but once they finish their talk, they are gone. Having this book serves to reinforce the information obtained from an expert speaker and gives you the advantage of having an onhand reference. If you regularly manage people or are an integral part of a human resources department, the price of this book is minor compared to the value it provides.

5 out of 5 stars Great with many real life examples   December 17, 2009

I learned to love NOLO publications with their in-depth analysis of various topics. In this age of frivolous lawsuits, when we often hear about how someone got fired for saying the wrong things on a job, it is great to have a book with real life examples analyzed and explained. And this is probably the greatest strength of this book: the many real-life examples and applications. This book helped me as an employee understand the rights I did not know I had, and where I need to stay away from questionable practices.

5 out of 5 stars Unbelievably Helpful Guide Based on Legal Principles, Finally!   October 30, 2009
    BOOK REVIEW
I cannot thank the authors enough for caring enough to write a book like this. Workplace harassment is so common place, and the only books I've ever found for dealing with it are self help books to help you address the emotional effects of harassment. This book tells you what your legal rights are and what action steps you can take to try and bring a stop to the behaviors that create hostile work environments. I highly recommend this book.

5 out of 5 stars Another NOLO guide to happier management of employees   December 12, 2009
    Joanna Daneman (Middletown, DE USA)
If you are not up to date on employment rules and legal findings on employee harrassment, and you have an employee, this is an easy way to become educated about what's required of you, and how to handle harrassment issues the right way. As usual, NOLO publishes a guide for the average person that is easy to read and interesting, yet manages to touch on the main issues with thoroughness.

    5 out of 5 stars Excellent   December 14, 2009

Nolo does it again with an easy, comprehensive, and concise guide for HR professionals and employers regarding harassment and discrimination issues.

The focus of the book is geared towards the employer not the "victim", but it gives enough information to help both. The book defines harassment and discrimination well by definition and by many examples. It takes the HR professional, supervisor or anyone in the position of dealing with these kinds of cases through the entire process and inserts common questions with their answers on each topic covered. It begins with the preventative measures, like having clearly defined company policies, and then proceeds through the entire complaint process. The steps used are balanced and deal with both sides, but the focus is always on the employer, guiding them as to how to prevent complaints and when receiving complaints, how to best deal with them legally as well as professionally.

There are forms included, state by state information and laws, and a CD-ROM with example interviews on it. The guide also includes diversity training and examples of how to structure company policies to deal with potential harassment and discrimination.

This legal guide is a must resource for any company serious about heading off harassment and discrimination lawsuits and complaints.
